1. Introduction

These Terms and Conditions govern your access to and use of the NHE Tutor App, the website newhigheducation.com, and any related digital learning services provided by New High Education.

By creating an account, accessing the platform, using the AI Tutor, registering as a student, parent, teacher, administrator, or using any related service, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must not use the NHE Tutor App or any related New High Education service.

New High Education is registered in Ghana and operates in accordance with applicable Ghanaian laws, including laws relating to data protection, electronic transactions, cybersecurity, child protection, education, consumer protection, and digital services. Ghanaโ€™s Data Protection Commission identifies the Data Protection Act, 2012 (Act 843) as the law that protects personal data in Ghana. (Data Protection Commission)

New High Education provides digital learning support, AI-assisted tutoring, curriculum-related educational guidance, and learning tools for students, parents, teachers, and approved administrators.


3. Definitions

In these Terms and Conditions:

โ€œAccountโ€ means a registered account created to access the NHE Tutor App or related services.

โ€œAI Tutorโ€ means the artificial intelligence-powered learning support feature provided through the NHE Tutor App.

โ€œAppโ€ means the NHE Tutor App.

โ€œContentโ€ means text, images, audio, video, documents, questions, answers, learning materials, AI-generated explanations, and any other material available on or submitted through the platform.

โ€œParentโ€ or โ€œGuardianโ€ means a person legally or practically responsible for supporting or supervising a student user.

โ€œPlatformโ€ means the NHE Tutor App, website, portals, dashboards, AI Tutor, and related services.

โ€œStudentโ€ means a learner registered or approved to use the NHE Tutor App.

โ€œTeacherโ€ means an approved educator or learning support person authorised by New High Education to access teacher-related features.

โ€œAdminโ€ means an approved user with administrative access to support account management, verification, monitoring, or platform operation.

โ€œSuper Adminโ€ means a higher-level administrator with authority to approve, assign, or manage certain user roles.

โ€œWeโ€, โ€œUsโ€, or โ€œOurโ€ means New High Education.

โ€œYouโ€ or โ€œUserโ€ means any person who uses the platform, including students, parents, teachers, administrators, and visitors.


4. Eligibility to Use the Platform

You may use the NHE Tutor App only if you are authorised to do so and agree to follow these Terms and Conditions.

The platform may be used by:

  • Approved students
  • Parents or guardians
  • Teachers
  • Admins
  • Super Admins
  • Other users authorised by New High Education

Students under the appropriate age of independent consent may require parent, guardian, school, or administrative approval before accessing certain features.

New High Education may refuse registration, delay approval, suspend access, or terminate an account where we believe the user is not eligible, has provided false information, or may pose a risk to the platform or other users.


5. Registration and Account Approval

To access restricted features of the NHE Tutor App, users may be required to create an account and provide accurate registration details.

Registration details may include:

  • Full name
  • Email address
  • Ghana mobile number
  • Student ID or parent ID
  • School level or class
  • Role information
  • Parent or guardian details
  • Teacher or admin verification details
  • Other information reasonably required for account setup or approval

New High Education may manually review and approve accounts before access is granted.

Students may be issued an ID in the format:

Parents or guardians may be issued an ID in the format:

NHEPXXXX

You are responsible for ensuring that all information provided during registration is accurate, complete, and up to date.


6. Account Security

You are responsible for keeping your login details, password, student ID, parent ID, and account access information secure.

You must not:

  • Share your login details with another person
  • Use another personโ€™s account
  • Allow unauthorised access to your account
  • Create fake accounts
  • Impersonate another student, parent, teacher, admin, or organisation
  • Attempt to bypass security controls

If you believe your account has been accessed without permission, you must contact New High Education immediately.

New High Education may suspend, reset, restrict, or terminate accounts where suspicious activity is detected.


7. Student Use of the Platform

Students must use the NHE Tutor App for lawful and educational purposes only.

Students are expected to:

  • Ask genuine learning questions
  • Use AI Tutor responses to improve understanding
  • Treat all users respectfully
  • Avoid abusive or harmful language
  • Keep personal information private
  • Follow instructions from authorised teachers, parents, or administrators
  • Use the platform honestly and responsibly

Students must not use the platform to cheat, bully, harass, threaten, impersonate others, access inappropriate content, or generate harmful materials.


8. Parent and Guardian Responsibilities

Parents and guardians play an important role in supporting student learning and safe platform use.

Parents and guardians are responsible for:

  • Helping students use the platform responsibly
  • Ensuring registration information is accurate
  • Protecting student login details
  • Supervising younger students where appropriate
  • Reporting concerns to New High Education
  • Ensuring that the student follows these Terms and Conditions

Where a parent or guardian account is linked to a student account, New High Education may require verification before allowing access to student-related information.


9. Teacher and Admin Responsibilities

Teachers, admins, and Super Admins must use their platform access only for authorised educational, administrative, or support purposes.

Teachers and admins must:

  • Act professionally and respectfully
  • Protect student and parent information
  • Use data only for authorised duties
  • Report safeguarding, security, or misuse concerns
  • Avoid misuse of administrative privileges
  • Follow all New High Education policies

Teachers and admins must not:

  • Share student data without permission
  • Use student information for personal purposes
  • Contact students inappropriately
  • Alter records dishonestly
  • Abuse their access rights
  • Use the platform for unauthorised commercial, religious, political, or personal promotion

Breach of this section may result in immediate removal of access and further action where necessary.


10. AI Tutor Use

The AI Tutor is provided as a learning support tool. It is designed to help students understand academic topics, practise learning, revise subjects, and receive educational explanations.

The AI Tutor does not replace:

  • Professional teachers
  • School instruction
  • Official textbooks
  • Ghana Education Service or NaCCA-approved materials
  • Examination body instructions
  • Parent or guardian supervision
  • Professional advice

AI-generated answers may sometimes be incomplete, inaccurate, unsuitable, or require further checking. Users should verify important information with teachers, textbooks, official curriculum materials, or other trusted sources.

You must not use the AI Tutor to:

  • Cheat in examinations or assignments
  • Generate harmful, sexual, abusive, hateful, fraudulent, or illegal content
  • Create threats, bullying messages, or harassment
  • Submit private personal information unnecessarily
  • Impersonate another person
  • Break school rules or examination rules

New High Education may monitor AI Tutor usage for safety, quality control, service improvement, abuse prevention, and platform security.


11. Academic Honesty

The NHE Tutor App is intended to support learning, not to replace personal effort or honest academic work.

Students must not submit AI-generated answers as their own work where this breaches school, teacher, or examination rules.

Students should use AI-generated explanations to:

  • Understand topics
  • Improve reasoning
  • Practise problem-solving
  • Revise concepts
  • Learn how to approach questions

New High Education is not responsible for academic penalties resulting from dishonest or improper use of the AI Tutor.


12. Educational Content

New High Education may provide educational content, including AI-generated explanations, study notes, practice questions, curriculum-related materials, and learning support resources.

We aim to provide helpful and relevant educational content. However, we do not guarantee that all content will always be accurate, complete, current, error-free, or suitable for every studentโ€™s specific learning needs.

New High Education may update, remove, correct, or change educational content at any time without prior notice.


13. Payments, Subscriptions, and Access Fees

Some services, features, accounts, subscriptions, or learning tools may require payment.

Payment may be accepted through approved payment methods, including Ghana mobile money or other authorised payment channels.

Access to paid services may depend on:

  • Successful registration
  • Account approval
  • Payment confirmation
  • Subscription status
  • Compliance with these Terms and Conditions

New High Education may restrict or suspend access where payment is not received, reversed, disputed, incomplete, expired, or fraudulent.

All fees, where applicable, will be communicated before or during the payment process.


14. Refunds and Cancellations

Refund requests may be considered on a case-by-case basis.

A refund may be considered where:

  • Access was not activated due to a fault from New High Education
  • A duplicate payment was made

Refunds may not be granted where:

  • The user violated these Terms and Conditions
  • The user provided incorrect information
  • The payment provider does not permit reversal
  • Access was suspended due to misconduct

15. Acceptable Use

You agree to use the NHE Tutor App only for lawful, respectful, educational, and authorised purposes.

You must not:

  • Abuse, bully, threaten, harass, or intimidate others
  • Upload viruses, malware, or harmful files
  • Attempt to hack, reverse engineer, damage, overload, or disrupt the platform
  • Access areas of the platform without permission
  • Share false or misleading information
  • Use the platform for fraud or impersonation
  • Collect another userโ€™s personal data without permission
  • Post or submit inappropriate, violent, sexual, hateful, or discriminatory content
  • Use the platform in breach of Ghanaian law or any applicable law

Ghanaโ€™s Cyber Security Authority was established under the Cybersecurity Act, 2020 (Act 1038) to regulate cybersecurity activities in Ghana and promote cybersecurity development, so users must treat platform security and online conduct seriously. (csa.gov.gh)


16. Child Safety and Safeguarding

New High Education takes child safety seriously.

No user may use the platform to exploit, groom, abuse, threaten, harass, bully, manipulate, or harm a child or young person.

Users must not request inappropriate personal information from students or send inappropriate messages, images, videos, links, or materials.

If New High Education becomes aware of a child safety concern, we may take urgent action, including:

  • Restricting or suspending accounts
  • Notifying parents or guardians
  • Notifying school representatives where appropriate
  • Preserving evidence
  • Reporting serious matters to relevant authorities

17. User-Generated Content

Users may submit questions, messages, prompts, documents, files, images, or other materials through the platform.

You are responsible for the content you submit.

You must not submit content that:

  • Belongs to another person without permission
  • Contains private information you are not authorised to share
  • Is abusive, threatening, hateful, sexual, violent, or unlawful
  • Encourages cheating, fraud, harm, or illegal conduct
  • Contains malware or harmful code
  • Violates another personโ€™s rights

By submitting content to the platform, you give New High Education permission to process, store, display, use, and transmit that content as needed to provide the service, generate AI Tutor responses, manage accounts, improve the platform, and comply with legal obligations.


18. Intellectual Property

All platform designs, branding, logos, systems, software, learning materials, text, graphics, layouts, databases, and content created by or for New High Education remain the property of New High Education or its licensors, unless otherwise stated.

You must not copy, reproduce, sell, distribute, modify, publish, or commercially exploit any part of the platform without written permission from New High Education.

Users may use educational responses and learning materials for personal study and learning purposes only, unless New High Education gives written permission for another use.


19. Third-Party Services

The NHE Tutor App may use third-party services such as:

Suspension or termination may be temporary or permanent depending on the seriousness of the breach.

25. Disclaimers

The NHE Tutor App is provided for educational support.

New High Education does not guarantee:

  • That all AI-generated answers will be correct
  • That students will pass examinations
  • That users will achieve specific grades
  • That the platform will meet every learning need
  • That the platform will be available at all times
  • That all content will be free from errors
  • That third-party services will always operate properly

Users should use the platform responsibly and confirm important educational information with teachers, textbooks, official curriculum resources, or other trusted sources.


26. Limitation of Liability

To the fullest extent permitted by law, New High Education will not be liable for:

  • Loss caused by misuse of the platform
  • Poor academic performance
  • Incorrect use of AI-generated content
  • User failure to follow school or examination rules
  • Loss caused by internet, device, or third-party service failure
  • Unauthorised access caused by a user sharing login details
  • Indirect, incidental, special, or consequential loss
  • Loss of data where reasonable safeguards were in place
  • Payment delays caused by third-party providers

Nothing in these Terms and Conditions excludes liability that cannot be excluded under applicable law.


27. Indemnity

You agree to indemnify and hold New High Education harmless from claims, losses, damages, liabilities, costs, or expenses arising from:
